Effective Date: 29 July 2026. Welcome to Pepper Bay Records. These Terms & Conditions govern your use of pepperbayrecords.in and all services provided by Pepper Bay Records. By accessing our website or using our services, you agree to be bound by these terms. If you do not agree, please do not use our website or services.
1. About Pepper Bay Records
Pepper Bay Records is an independent record label based in India, providing artist onboarding, music distribution, release management, artist development, creative services, and promotional support for independent artists. Website: pepperbayrecords.in. Email: contact@pepperbayrecords.in.
2. Eligibility
You must be at least 18 years old, or have permission from a parent or legal guardian; have legal authority to enter into this agreement; and own or have the necessary rights to any music or content submitted to Pepper Bay Records.
3. Our Services
We may provide artist onboarding, music distribution, release and roster management, demo review, press kit creation, music production, mixing and mastering, artwork and motion design, photography, videography, express advertising, and artist support. Some services are included with artist onboarding; others are optional paid services.
4. Artist Applications
Submitting an application or demo does not guarantee acceptance. Pepper Bay Records may accept or reject applications, request additional information, or decline content that does not meet our quality, technical, or legal requirements. Decisions regarding artist acceptance are final.
5. Artist Responsibilities
By submitting content, you confirm that you own or control all necessary rights; your music does not infringe copyright, trademark, or other intellectual property rights; collaborators have granted permissions where required; metadata, credits, and release information are accurate; and content complies with applicable laws and platform requirements. Artists remain responsible for the accuracy of submitted information.
6. One-Time Artist Onboarding
A one-time artist onboarding fee is payable only after a release has been reviewed, approved, and accepted for distribution through our label account. After onboarding, an artist profile may be added to the roster and future releases may be submitted without another onboarding fee, subject to these terms, quality review, legal compliance, and platform requirements. We may modify, suspend, or discontinue the programme where necessary.
7. Optional Paid Services & Payments
Music production, mixing, mastering, artwork, motion artwork, photography, videography, express advertising, creative consultation, and promotional services may require additional payment. Pricing may change without prior notice. Payments may be accepted through UPI, Razorpay, and bank transfer. Paid services begin only after successful payment unless agreed otherwise in writing.
8. Music Ownership & Distribution
Artists retain ownership of original music and intellectual property unless otherwise agreed in writing. By submitting content, artists grant Pepper Bay Records the permissions necessary to review submissions, prepare and distribute releases through authorised partners, deliver content to streaming platforms, and promote releases using submitted artwork, artist names, and approved promotional materials. This permission is limited to agreed services.
9. Platform Decisions & Release Approval
While we make every effort to ensure timely delivery, we cannot guarantee platform approval, playlist placements, third-party controlled release dates, availability, search rankings, streaming performance, or revenue. We may delay, reject, or remove releases where copyright concerns, inaccurate metadata, insufficient audio quality, artwork issues, suspected fraud, legal issues, or partner rejection arise.
10. Intellectual Property, Conduct & Termination
Our logos, branding, graphics, layouts, and written materials remain the intellectual property of Pepper Bay Records unless stated otherwise. Users must not submit stolen music, upload malicious software, misrepresent ownership, interfere with security, abuse staff or systems, or use services unlawfully. Violations may lead to suspension or termination, including where fraud, infringement, unpaid amounts, or legal obligations require action.
11. Liability, Law & Changes
To the fullest extent permitted by law, Pepper Bay Records is not liable for lost revenue, streaming income, third-party delays, platform decisions, outages, data loss beyond our reasonable control, or indirect damages. Liability is limited to the amount paid directly for the service giving rise to a claim where permitted. These terms are governed by the laws of India. We may update services or these terms at any time; continued use after changes take effect constitutes acceptance.
